A Speeding Ticket Defense - Challenging Calibration Records

This is a tip to keep in mind if you are trying to fight a speeding ticket in court and build your defense. This may not work in all jurisdictions, because the laws and violations vary from place to place so it is important to find out if it is valid in the jurisdiction who are fighting speeding in.

There is something called calibration records that the officer is responsible for maintaining. They have to maintain records of calibration of radar gun and in some cases their speedometers is rhythm method is allowed to take someone.

Records of calibration of the radar gun are important because the radar guns can be wrong. The jurisdiction decides that each radar gun must be calibrated every 3 months, 6 months or whatever period is decided in that area. This is important because a faulty gun could end up giving tickets to many people when it accelerates. He is responsible for maintaining this record.

You can request these documents in court. If the officer does not have the record, then you have a better chance of winning. More realistically should have this record with them. Just make sure you know how many months' validity before it expires.

Another calibration log to keep some areas is the officer's speedometer. Some places allow an office to track or beat you and determine your speed to give you a ticket. They should have your speedometer calibrated for the same reasons as their radar guns to ensure accuracy. If your jurisdiction allows, ask the registry as well.
